Action for death by wrongful act brought in the Dakota County District Court by David Hamilton Samuelson as trustee for the heirs of Selma Samuelson, who died when the automobile in which she was a passenger collided with a train operated by defendant Chicago, Rock Island and Pacific Railroad Company on a right-of-way maintained by defendant Chicago, Milwaukee, St. Paul and Pacific Railroad Company. The former defendant filed a third-party complaint against David Urban Samuelson, driver of the automobile in which decedent was riding. The issues raised by this complaint were tried before Robert J. Breunig, Judge, and a jury, which found in a special verdict that third-party defendant was negligent, that his negligence was a direct cause of the accident, and that settlement of plaintiff's claim by third-party plaintiff for $1,500 was reasonable. The court ordered judgment for $750 in favor of third-party plaintiff against third-party defendant, and he appealed from an order denying his alternative motion for judgment notwithstanding the verdict or for a new trial.
